Terms of Service

1. Introduction
Welcome to Letz Charter ("Platform"), operated by American Trans-Data, Corp. ("Company," "we," "us," or "our"). Letz Charter is an online marketplace connecting customers seeking group transportation and charter services with independent transportation operators.
By accessing or using the Platform at letzcharter.com, app.letzcharter.com, or any associated subdomains, mobile applications, or APIs, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
These Terms apply to all Users, including:
- Customers — individuals or organizations seeking transportation services
- Operators — transportation companies offering services through the Platform
- Organizers — individuals coordinating group transportation events
2. The Platform
2.1 Marketplace Role
Letz Charter is a marketplace. We connect Customers with Operators. We are not a transportation provider. We do not own vehicles, employ drivers, or provide transportation services. All transportation services are provided by independent Operators.
2.2 No Agency Relationship
We do not act as an agent for any Operator or Customer. When you book through Letz Charter, your contract for transportation services is directly with the Operator. We facilitate the connection, quote generation, and payment processing.
2.3 No Guaranteed Availability
We do not guarantee that Operators will be available for any given date, route, vehicle type, or service area.
3. Accounts
You must create an account to use certain features. You agree to provide accurate information, maintain the security of your credentials, and notify us immediately of unauthorized access. You are responsible for all activity under your account.
We may suspend or terminate accounts that violate these Terms, the Acceptable Use Policy, or applicable law.
4. Customer Terms
4.1 Quotes and Pricing
Instant quotes are generated automatically from Operator pricing rules. Prices are valid at the time of display and confirmed at checkout.
4.2 Payments
Payments are processed through Stripe. Payment may be collected as a deposit or in full at booking, per Operator configuration. Processing fees are absorbed by the Platform.
4.3 Cancellations and Refunds
Cancellation terms are set by each Operator and displayed before booking. Default terms:

4.4 Customer Responsibilities
Provide accurate trip details, arrive on time, treat Operators and vehicles with respect, comply with all laws and Operator policies, and do not exceed passenger capacity.
5. Operator Terms
5.1 Eligibility
Operators must be a legally registered business, hold all required licenses and permits (FMCSA/DOT, USCG, or equivalent), maintain adequate insurance, and comply with safety regulations.
5.2 Pricing
Operators set their own prices. The Platform does not set, recommend, or cap Operator pricing. Operators configure pricing rules; the Platform generates customer-facing quotes.
5.3 Payments to Operators
Customer payments are collected via Stripe. The Platform deducts the applicable commission and transfers the remainder to the Operator's connected Stripe account. Operators are responsible for their own tax reporting.
5.4 Commission Rates

5.5 Customer Selection
Customers choose Operators — not algorithms. We do not auto-assign customers, boost search rankings for payment, or hide operator identities.
5.6 No Exclusivity
Operators may use other platforms and accept direct bookings simultaneously.
6. Prohibited Conduct
All Users agree not to: violate any law, provide false information, discriminate, harass other Users, circumvent Platform fees, interfere with Platform operations, or scrape Platform content. See our Acceptable Use Policy.
7. Intellectual Property
The Platform is property of American Trans-Data, Corp. You retain ownership of content you submit and grant us a non-exclusive license to display it on the Platform.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS." We make no warranties, express or implied. We do not provide transportation services and are not responsible for the quality, safety, or timeliness of Operator services.
9. Limitation of Liability
Our total liability shall not exceed the fees paid by you in the preceding twelve months or $100, whichever is greater. We are not liable for indirect, incidental, or consequential damages, or for loss arising from transportation services provided by Operators.
10. Dispute Resolution
Disputes shall first be addressed through good-faith negotiation (30 days), then binding arbitration under AAA rules in the State of Delaware. You agree to resolve disputes individually and waive class action rights.
11. Changes to Terms
We may update these Terms with 30 days notice. Continued use after changes take effect constitutes acceptance.
12. General Provisions
Governing Law: State of Delaware. These Terms, together with our Privacy Policy, Cancellation Policy, and Cookie Policy, constitute the entire agreement.
